The sale of an original work does not transfer reproduction rights, which remain the property of the artist. Any reproduction, even partial, is prohibited without prior written permission.
The works offered are original, one-of-a-kind, hand-painted pieces. Photographs aim to represent each work as faithfully as possible; slight colour variations may appear depending on the buyer's screen and cannot engage the seller's liability. The dimensions given are those of the canvas.
Prices are shown in euros, all taxes included. VAT not applicable, article 293 B of the French General Tax Code (VAT exemption scheme). Shipping costs are stated before the order is confirmed. The artist reserves the right to change prices at any time; each work is invoiced at the price in force at the time of the order.
An order is placed by clicking the purchase button for the chosen work. Payment is processed securely by our provider Stripe; no card details are stored by the artist. The sale is final once payment is confirmed. As each work is unique, it is withdrawn from sale as soon as it is sold.
Works are shipped worldwide. Depending on their size and support, they are sent either stretched on their frame or rolled in a protective tube; the shipping method is stated for each work or communicated before dispatch. Every shipment is carefully packed and insured for its value.
Works are generally dispatched within 5 working days of receipt of payment. Delivery times then depend on the carrier and destination.
Deliveries outside the European Union: any customs duties, import taxes and clearance formalities are the buyer's responsibility and are billed directly to the buyer by the authorities or carrier in their country. These amounts are additional to the price paid on the site.
If a parcel arrives damaged, the buyer is asked to note reservations with the carrier and to contact the artist within 48 hours, with photographs if possible, so that a solution can be found.
In accordance with articles L.221-18 et seq. of the French Consumer Code, a consumer buyer has fourteen (14) days from receipt of the work to exercise their right of withdrawal, without needing to give a reason.
To do so, the buyer notifies the artist by email at contact@aldo-desilvestri.com. The work must be returned in its original packaging, in perfect condition. Return shipping costs are borne by the buyer. The amount paid is refunded within fourteen (14) days of recovering the work in good condition.
In accordance with article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to commissioned works made specially to the buyer's specifications.
Data collected when ordering (name, address, email) is used solely to process the order and delivery. It is neither sold nor shared with third parties, except providers required to fulfil the order (payment, shipping). Under the General Data Protection Regulation (GDPR), the buyer has the right to access, correct and delete their data by emailing contact@aldo-desilvestri.com.
These terms are governed by French law. In the event of a dispute, an amicable solution will be sought first. Failing that, the buyer may use the European online dispute resolution platform or bring the matter before the competent court.
